The Rolling Hills Estates Improvement Association actively enforces its Covenants, Conditions & Restrictions. Please note that among these are requirements for the Association’s prior review of building and architectural plans, fences, modifications, restrictions regarding vehicle parking, prohibitions against short term rentals (i.e., those less than 30 days) and restrictions against home use for business, such as (but not limited to) event staging or commercial gatherings.
Rolling Hills wishes to maintain its aesthetic as a residential neighborhood and is particularly concerned about potential violations of its prohibition against short term rentals. We have seen what this has done to those Sedona neighborhoods that have no restrictions against short term rentals, or those that fail to enforce their restrictions.
Realtors and investors are urged to read the RHEIA CC&Rs (found at https://www.rheiassociation.com/covenants-conditions--restrictions.html) prior to any purchase of property in Rolling Hills. While all CC&Rs must be observed, recent trends many neighborhoods have experienced in Sedona with short term rentals attunes Rolling Hills to the need for vigilance and aggressive legal action when needed to stop short term rentals. We will not hesitate to go after violators with fines, injunction requests, attorney fee or court cost collections or seeking action from short term rental agencies such as airbnb or VRBO to remove owners violating our restrictions with their advertising or contracts. Moreover, we will take legal action where required not only against such owners, but those short term leasing agencies, realtors or companies who abet or enable such violations by their indifference or active participation.
Realtors are reminded that sales of property in Rolling Hills carry a $300 transaction fee paid by buyer and that the new owner’s name and contact information are required. Realtors must also provide buyers with our CC&Rs prior to purchase. While ignorance of these CC&Rs is no excuse for violations, realtors are particularly urged to emphasize to potential investors that RH will not tolerate misuse of properties as short term rentals or for commercial gatherings.
